The nuances of employing minor children under the Labor Code - how is an employment contract concluded before and after the age of 14, and from the age of 16?

Organization and working hours for children under 18 years of age

Remuneration of a minor and financial liability of an employee under 18 years of age

Remuneration for children occurs in accordance with Article 271 of the Labor Code of the Russian Federation.

Salary is calculated taking into account:

Time worked – taking into account the hours or shifts worked by the minor.
Piece work done. The prices for this piecework type of labor are taken into account.

Additional payments may be made, but note that the employer may not make them, since the law cannot force him to do so.

Production standards are established according to the reduced duration of the working period for children (Article 270 of the Labor Code of the Russian Federation).

Children can compensate the employer for causing damage:

Termination of an employment contract with working children under 18 years of age - how to properly dismiss a minor employee under the Law?

Termination of a contract with a child is possible according to the following rules:

Official, written consent must be obtained from the State Labor Inspectorate and the Commission on Minors' Affairs.
If written consent was not obtained, then the working conditions for the child are taken into account. For example, a minor has signed a contract, but working conditions have changed and he cannot perform the work he did before. In this case, the contract may be terminated.
Liquidation or bankruptcy of a company is grounds for termination of a contract on the initiative of the head of the organization.
If consent was not received from the inspection and commission and the employer did not have the right to terminate the TD, then he may be held accountable. Typically, the employer pays for the employee’s forced absence.
The employee cannot perform work due to failure to undergo a medical examination. Here the issue should be resolved through the courts.
