All country real estate in the Moscow region has already been photographed. The government of the Moscow region told Business FM how and for what summer residents will soon pay tax. Earlier, information appeared that aerial photography of objects would take place until May, after which owners of unregistered permanent buildings might be subject to a triple tax. There is a lot of information floating around about what will happen, what won’t happen, what summer residents should do, what they shouldn’t do, what flies over their dachas, what doesn’t fly there, what needs to be registered, what doesn’t need to be registered. Andrey Averkiev: I will try to give objective information about what is happening today in the Moscow region, what our colleagues in municipalities are doing under our organizational leadership - the Ministry of Property Relations. Our main task is not fences, not bathhouses, not greenhouses. We started this work in May-June 2016, when we saw that quite serious objects, namely houses, real houses with an area of ​​several hundred square meters, sometimes thousands of square meters, entire palaces are not registered in the cadastral register, property rights are not registered on them, and accordingly, such objects are not subject to taxation. We calculated how many there could be in the region. Of course, this is a forecast figure, but it still amazed us. We went through several settlements, several villages and saw that about 30% of objects are not registered in the cadastral register, are not registered, and therefore are not subject to taxation. And with elementary mathematical calculations we came to the conclusion that there could be about half a million such objects in the region. We understand that the system of registration of rights, the cadastral registration system in our country is quite complex according to the legislation, but still this is not a reason not to register objects and, in fact, evade taxes. Some of our residents, of course, are frightened by this complex procedure, and some, for sure, deliberately do not register their properties with the cadastral register and, in fact, evade taxes. And when we saw this, we set ourselves a simple task to identify such objects, and here we took advantage of the information resources that were created in the Moscow region. It is clear that no quadcopters fly.

They said that aerial photography was being carried out.

Andrey Averkiev : Let me explain. Aerial photography of the entire territory of the Moscow region was carried out in 2014. It was a government order, a government purchase, when a professional organization flew around the entire Moscow region on an airplane with special cameras. This survey was stitched and superimposed on a cartographic resource, that is, we received a map of the Moscow region, but not in the form of all known symbols, but in the form of a real photographic image. Moreover, this image is high-quality, highly detailed, and from this aerial photograph you can see everything right down to the car and some small forms. No one is currently flying over the area; this aerial photo is from 2014. Real estate cadastre data was superimposed on this aerial photograph, information was obtained from Rosreestr on registered rights, and information was received from the tax service on which real estate properties the tax is paid on. And when we combined all these information sources, we saw that, indeed, quite a significant number of buildings, and serious buildings, not fences or wells, are actually missing from the cadastre and tax inspectorate data. We have identified precisely such objects, and now the third stage is to identify the owners of such houses, and we understand, I repeat, this is important, that the aerial photography was carried out in 2014, and today we are in 2017, more than two years have passed , and it is obvious that during the walkthroughs that we conduct together with colleagues from municipalities, we see that these houses are actually used, people live in them, they are connected to electricity, they pay for gas, the light is visible there, and we understand that the houses are really subject to taxation, these are operating, residential properties. And there are about 500 thousand such objects, we predict, and their owners are the object of our search, and our task is to remind each of these owners that it is necessary to protect, including their property rights to the objects in which they live, to register them, and, accordingly, as a logical consequence, it is to become a payer of property tax for individuals, like all other citizens of the country. This is the essence of our actions. It is clear that there may be other related facilities on the land plots. We know that there is a big house, a main house. A guest house can be built on a plot of land, a garage for several cars with utility rooms, a bathhouse, bathhouses are also not 5x6 log houses, but there are objects that are quite large in size - these are all capital construction projects, these are all things that are also subject to registration of rights and taxation. Therefore, our emphasis on these objects is capital objects, not fences.

When they wrote about all this, they referred to the government of the Moscow region, and it was, as everyone understood, about aerial photography, and they thought that now drones are flying to reveal all this.

Andrey Averkiev: Of course not.

And the fact that a lot could have changed since 2014, has something else been built?

Andrey Averkiev: It could, but this is the next stage in our work. We are moving consistently, step by step, that during this time new houses have appeared, we understand that construction is ongoing, holiday villages are growing, and someone is not registering the rights to newly built objects, but I repeat, step by step, let us go consistently, First, let's look at those objects that were built before 2014.

But people are worried nonetheless. Because I understand your desire to take taxes from luxurious palaces, but summer residents are worried that their summer houses and any capital construction projects located on the plots will be subject to taxes.

Andrey Averkiev: We are sensible people, and it’s clear why waste time and effort on objects that, in principle, are not subject to taxation, such as gazebos. And one more thing important point: many people forget about it and don’t know, the fact is that in accordance with tax legislation, the Tax Code, objects with an area of ​​less than 50 square meters are not subject to taxation at all. This is a tax deduction. Relatively speaking, you have a house of 100 square meters, the tax deduction is 50, 100 minus 50, and only an area equal to 50 square meters will be subject to property tax. If your house is less than 50 square meters, some garden house is 30 square meters 5x6, then it is not subject to taxation.

However, we are already being told stories that people - there is no law yet - but they are already receiving certain notifications from the tax office regarding specifically such small buildings.

Andrey Averkiev: While doing this work, it is clear that the logical conclusion is that when we identified an unregistered house using aerial photography, as a result of a walk-through on the ground, we were convinced that it exists, that it is residential, that they live there, which means the next step is notification from the district tax inspectorate to the owner of such a house, which, as a rule, we hand over against a receipt, stating that “dear resident of the Moscow region, we saw that you are the owner of such a building, that your building is not registered, that you do not pay tax as required , be kind enough to do such and such.” This concerns the logical conclusion of this work. And then we hope that, as a rule, people respond, especially since we help, give a clear algorithm of actions, simplify life, try to reduce labor costs, attract our subordinate enterprise - the Moscow Regional BTI - to register such objects in the cadastral register and provide all possible assistance advisory assistance. We have many employees whose phone numbers are listed in such notifications; accordingly, we receive calls from residents and we advise on how to proceed. As for the tax notices that people are already receiving, but these notices are received as usual. Here I do not exclude errors, because all the same, it must be admitted, there are individual errors in both the tax service databases and the State Real Estate Cadastre. We have more than 8 million real estate properties in our region - these include apartments and rooms, and, unfortunately, there are mistakes that entail even such funny examples, although people who receive tax notices are definitely not amused, but we have encountered this, it is clear that a few times when, for example, the area of ​​​​an apartment in a residential building is taken into account as the area of ​​​​the entire residential building, and the program automatically The tax service calculates the tax for a one-room apartment not for 40 square meters, relatively speaking, but for several thousand square meters, and the citizen, the owner, receives a tax of several hundred thousand rubles. This is an obvious mistake. It is clear that it can be corrected; it is a technical error, an error in the State Real Estate Cadastre. There is no need to be afraid, here we explain to people that they just need to either inform the Ministry of Property Relations via our email, or through the Dobrodel portal they can report such an error, and indisputably, out of court, we correct such errors. There is no need to be scared, it’s all within the margin of error.

Andrey Vladimirovich, radio listeners ask this question. Here is a man who has a 4x4 meter house on his property, standing on wooden poles dug into the ground. People come to the Registration Chamber and ask whether it is necessary to register? They are told: register if you want, or not, but if you register, you will pay tax. What should they do?

Andrey Averkiev: It's really optional here. If you want to register such a house with an area of ​​16 square meters as a real estate property, then you have the right to do so. But this object will not be subject to taxation, because there is a tax deduction - 50 square meters.

That is, neither a simple tax nor a triple tax will be levied on him?

Andrey Averkiev: No tax will be charged on it. I wanted to dwell in a little more detail on another error that is being replicated. This is a triple tax. We are talking about something slightly different, not about a triple tax on a house, but about a property tax, because it is impossible to take any tax there, because this house is not an object of taxation. After all, there is another initiative, the initiative of the Federal Tax Service, the Ministry of Finance of the Russian Federation to increase the land tax on a land plot. Because let’s imagine this example: you are the owner of a plot of land and have decided to build a country house on the plot. It is clear that if you were not the owner, then you would not even build a house, because the risks are great, this is completely unauthorized construction, and you can lose money. But if you are the owner, then you understand that the house you built does not need to be registered and you don’t have to pay taxes on it. This is the same situation that I just described in detail. And the point is that since we cannot levy a property tax on an unregistered house, the logic is as follows: we identify such a house, identify the owner of the land plot who built such a house, and say: since you have not registered the house, the tax is on the house If you don’t pay, be kind enough to pay with some increasing factor, for example, three, the land tax. We pay two taxes: land tax on a land plot, property tax on a house on a land plot. Therefore, this is exactly what we are talking about.

From December 2009 to the present, as a result of the measures taken, funds and property totaling more than 9.7 billion rubles were returned to the budget of the Moscow region.
